Breaking News: FY 2024 H-1B Cap Petitions Set to be Filed from April 1st - Selection Process Completed
The last 3-4 days of speculation have ended today with the announcement from the U.S. Citizenship and Immigration Services (USCIS) that the electronic registration selection process for H-1B FY 2024 has been completed. We have the latest news USCIS about the selection process.
FY 2024 H-1B Lottery Updates
During the initial registration period, U.S. Citizenship and Immigration Services (USCIS) has received a sufficient number of electronic registrations to fulfill the numerical allocations for the H-1B cap, including the advanced degree exemption for the fiscal year (FY) 2024.
To reach the cap, USCIS has randomly selected registrations (or lottery done) that meet the criteria, and informed all potential petitioners with selected registrations that they are eligible to file an H-1B cap-subject petition for the named beneficiary.
FY 2024 H-1B Selection Process Updates
As we mentioned in our earlier post about H-1B, several individuals have started receiving emails from USCIS regarding their status change. USCIS has now officially confirmed this update with the latest information stating:
For each beneficiary registered, the online accounts of the registrants will display one of the following statuses:
- Submitted: The registration has been successfully submitted and is eligible for selection. If the initial selection process has already occurred, this registration remains eligible unless it is invalidated, and can be considered in subsequent selections for the applicable fiscal year.
- Selected: The registration has been chosen for filing an H-1B cap petition.
- Denied: Multiple registrations were submitted by or on behalf of the same registrant for the same beneficiary. If the registration is denied due to duplication, all registrations submitted by or on behalf of the same registrant for that beneficiary during the fiscal year will be invalid.
- Invalidated-Failed Payment: Although the registration was submitted, the payment method was declined, disputed, not reconciled, or otherwise invalid.
Only petitioners with selected registrations may file H-1B cap-subject petitions for FY 2024, and only for the beneficiary specified in the relevant selected registration notice. The H-1B cap-subject petition must be filed correctly at the appropriate service center within the time frame indicated in the relevant registration selection notice.
The filing period for the H-1B cap-subject petition will be at least 90 days. Online filing is not available for H-1B petitions, so the petition must be filed via paper. A printed copy of the applicable registration selection notice must be included with the FY 2024 H-1B cap-subject petition.
